Judge expands lawsuit against Labor Department

North Dakotans who are awaiting decisions on the merits of discrimination complaints filed with the state Labor Department should be included in a lawsuit against the agency, a judge ruled. The decision by East Central District Judge Douglas Herman may cover more than 100 people. All have filed complaints with the Labor Department, but do not have agency decisions--called findings of probable cause--about whether their claims have merit. "Despite scores (hundreds?) of charges being filed, the department has only issued probable cause notices to eight claimants," Herman wrote. "This pattern of inaction, even if from lack of funding (or) staffing, is contrary to the legislative mandate and the remedial nature of the North Dakota Human Rights Act."
